How to fight a Carpool / HOV Lane Violation 21655.5(b) in California?
I know all about trial by declaration, etc. but is there any motion for pre-trial discovery here? After reading the Code, I don’t see an opportunity to argue the code factually. I know I can argue my constitutional rights, hope the officer doesn’t show, and/or try to pay it before it’s in the system since a declined payment is a dismissed payment, but does anyone have any pointers to conduct a factual arguement or should I just continue to make my case too painful for the officer / DA via discovery motions?

Yeah, I don’t see a grounds for a discovery motion and I know these drivers are hated on the road; I won’t bother to argue that.
I did, however, forget to mention to save hate answers for someone who will be demoralized / demeaned by them.

You might be able to get pointers on how to conduct a factual argument if you let us know what factual argument there might be. It seems to me either you were in the HOV lane or you weren’t, and you either had a passenger or you didn’t, and it is very unlikely that a police officer would make a mistake regarding either of these circumstances.
