If you injure yourself playing sports and can’t work, can you be fired from your job? I live in Canada.?

A coworker of mine (who I carpool with), recently injured his knee pretty badly playing sports. He might be out for a couple of months for surjury. He claims that he can’t be fired from work because it’s illegal – I don’t know if I agree. This is a full-time summer job. Can anyone help shed some light on this? I live in Ontario, Canada.

Of the five requirements of a contract, the most contentious are the exchange of performance and consideration. Basically, one party agrees to do something and the other offers something of value. It is usually, but not necessarily, cash.

This is your contract and any alteration by either party is called non-compliance. Just as the employer is in violation if they don’t pay, the contract is voided if the work is not performed as agreed. Not only is the company unlikely to pay for a self imposed long term absence, they will probably choose to refill the position to meet their immediate needs.

I can’t see how any employer refusing to pay a temporary for job ending absence could be illegal, even in Canada.
